Part II

The amounts charged are based on planned use. All payments must be made 15 calendar days prior to the use of facilities; failure to do so could void this request. Payments must be made by credit card or cashier’s check. Personal checks are not accepted.
The applicant will be responsible for payment of the custodian and any other personnel. Payment will be made to RISE Charter School only.
This contract may be canceled by the Director of Operations or the Executive Director at its discretion should information be disclosed that improper, illegal or immoral activities/behavior are promoted, allowed or permitted.
The applicant will take such measures as needed to protect the school’s property while in their possession and understands that you will be held financially responsible, if you fail to undertake these measures.
The applicant agrees to indemnify and hold harmless RISE Charter School, RISE Charter School Board of Directors, and all their officers, employees, and agents from any and all claims, demands, suits, causes of action, or judgments any person had, now has, or may have in the future against the event which is subject to this agreement.
RISE Charter School is not liable for anything done or sponsored by the applicant while you are using the facilities.
There will be ABSOLUTELY no smoking or alcoholic beverages allowed on the school’s premises.

I have read and agree to abide by the rules and regulations governing facility usage at RISE Charter School. I understand that I will be responsible and billed for payment for any additional hours utilized but not listed on this contract.

Part III

Events sponsored by RISE Charter School have first priority for use of the school facilities. Anyone, including employees, wishing to rent/use school facilities must complete an application.
A completed application must be submitted to the DoO/Facility Manager 30 days in advance of the proposed event. The application should be completed in full and returned with a $100.00 non-refundable application fee. All other payments must be made 15 days prior to the start of your event, or risk cancellation.
The DoO/Facility Manager will determine availability of the particular site and whether an application is approved or denied. Approved applications are non-transferable. No facilities will be available for rent during a holiday week. All nightly events must conclude no later than 9:00 pm. Premises must be cleaned and vacated no later than 9:30 pm. Cancellations must be made at least 15 days prior to the scheduled event.
Applicants are to pay RISE Charter School in full and in advance, the quoted charge(s). Fees are based upon costs of utilities, supplies, maintenance, custodial services and other personnel costs. If use exceeds the quoted charges, applicant(s) will be billed for the additional costs.
A school official shall be on duty when the facility is open for public use. He/she will be responsible for the school, and the renting party will follow his/her directions on appropriate use of facilities. School official(s) at his/her discretion may require security services for any event to protect the interests of the school. Police protection, if needed, must be provided by, and paid for, by the applicant.
All activities must have appropriate adult supervision especially when children are involved. The applicant will assume full responsibility for payment of all damages and/or loss to facilities and/or school owned equipment that occurs during use.
Rental furniture may be used. The applicant renting the facility may rearrange school furniture with prior approval of school officials. The user must return moved furniture and equipment to its proper location before departure from the property.
RISE Charter School is a North Carolina public charter school. Smoking is prohibited; no visitor shall be permitted under any circumstances to use tobacco products in or on the grounds of RISE Charter School property. The use of open flames, gambling, and alcoholic beverages are also prohibited on RISE Charter School property.
Facilities should not be used during inclement weather or at other inappropriate times. In the event of an emergency, the school official is authorized to use their discretion for cancellation of events (e.g. inclement weather). *** If the school is closed due to inclement weather, emergency, etc., all events and rentals are cancelled until the school is officially reopened. ***
Every effort will be made to facilitate the heating and air conditioning needs for your event. Due to the nature of the RISE Charter HVAC support, there will be no compensation for the failure of heating and air conditioning when you agree to rent or use RISE Charter School facilities.

Release of Liability

By signing this agreement, I waive my rights to bring any legal action now or at any time in the future to recover compensation or to obtain any other legal remedy for any injury to myself or my property arising out of the use of the RISE Charter facilities. This release extends to all persons in attendance at my event. I agree, as permitted by law, to defend, indemnify, and hold harmless RISE Charter School, its employee, agents and assignees, from all liability, claims, actions, damages, costs, and expenses including reasonable attorney fees and costs, arising out of the negligent act or omission of any person using the RISE Charter facilities. No indebtedness of any kind incurred by RISE Charter Education, Inc. DBA RISE Charter School, a North Carolina charter school, shall constitute an indebtedness of the State of North Carolina or its political subdivisions, and no indebtedness of the said charter school shall involve, or be secured by, the faith, credit or taxing power of the State of North Carolina or its political subdivisions.
